Terms of Service

By downloading, installing, accessing, or using the MindVault desktop application, website, or APIs (collectively, the "Services"), you agree to be legally bound by these Terms of Service ("Terms").

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use MindVault. If you are using the Services on behalf of an academic institution, laboratory, or enterprise, you represent and warrant that you have full authority to bind that entity to these Terms.

MindVault grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute the MindVault client application on compatible computers (Windows, macOS, Linux) for your personal, research, or authorized internal business purposes.

You agree not to: * Reverse engineer, decompile, or disassemble the proprietary closed-loop audio algorithms or DSP classification engines beyond what is permitted by applicable open-source components. * Rent, lease, sublicense, resell, or distribute the proprietary software binaries without our prior written consent. * Use the Services to develop a competing commercial neurofeedback product or deceptive BCI service.

• * Photosensitive Epilepsy Warning: Certain audio-visual biofeedback protocols, visual spectrogram animations, or 40 Hz gamma acoustic pulses may provoke seizures or disorientation in susceptible individuals. If you or any member of your family has an epileptic condition or has experienced seizures, consult your physician before using MindVault.
• * Acoustic & Binaural Stimulation: MindVault synthesizes parametric binaural beats, isochronic pulses, and pink noise soundscapes. Do NOT use audio entrainment sessions while driving, operating heavy machinery, piloting aircraft, or engaging in activities requiring vigilant sensory attention.
• * Immediate Discontinuation: Discontinue use immediately if you experience dizziness, altered vision, involuntary eye or muscle twitching, nausea, loss of awareness, or severe disorientation.

MindVault is provided exclusively for educational, cognitive research, meditation, and personal development purposes. The software does not provide medical advice, diagnosis, or clinical treatments.

Never disregard professional medical guidance or delay seeking clinical care because of data, metrics, or graphs displayed within MindVault. Use of the software does not establish a doctor-patient relationship.

MindVault interfaces with third-party biometric hardware, including the Muse S Athena (MS-03) and Muse 2 headbands manufactured by InteraXon Inc.

MindVault is an independent software application developed independently of InteraXon Inc. MindVault is not affiliated with, sponsored by, endorsed by, or certified by InteraXon Inc. "Muse", "Muse S", "Muse 2", and "InteraXon" are trademarks or registered trademarks of InteraXon Inc. You are solely responsible for properly maintaining your physical hardware and adhering to the manufacturer’s operating guidelines.

Certain features (such as advanced fNIRS hemodynamics, LSL streaming bridges, or multi-channel EDF exports) may require a paid subscription or lifetime pioneer license.

• * Billing Cycles: Subscriptions are billed in advance on a recurring monthly or annual basis.
• * Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it prior to the renewal date via your account dashboard.
• * Taxes: All fees are exclusive of applicable federal, state, local, or value-added taxes unless stated otherwise.

WE EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL MINDVAULT, ITS FOUNDERS, DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, DEVICE MALFUNCTION, OR BODILY INJURY RESULTING FROM MISUSE OF SENSORY STIMULATION.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding individual arbitration.
